Welcome to Micromag. By accessing or using our platform at micromag.app, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

If you do not agree with any part of these terms, you may not access or use Micromag.

1. Acceptance of Terms

By creating an account or using Micromag, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

2. User Accounts

Account Creation: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security: You must notify us immediately of any unauthorized access or security breach. Micromag is not liable for any loss or damage arising from your failure to protect your account information.

Account Termination: We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.

3. Content Ownership and Rights

Your Content: You retain all ownership rights to the content you create and publish on Micromag, including text, images, videos, and other materials ("User Content").

License to Micromag: By publishing content on Micromag, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, and distribute your User Content solely for the purposes of operating, promoting, and improving our platform.

Content Responsibility: You are solely responsible for all User Content you publish. You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not infringe upon the intellectual property rights of any third party.

4. Prohibited Content and Conduct

You agree not to create, upload, or publish content that:

• Violates any applicable laws or regulations
• Infringes upon the intellectual property rights of others
• Contains hate speech, harassment, or discriminatory content
• Promotes violence, illegal activities, or self-harm
• Contains sexually explicit or pornographic material
• Includes spam, malware, or phishing attempts
• Impersonates any person or entity
• Contains false or misleading information

We reserve the right to remove any content that violates these Terms or that we deem inappropriate at our sole discretion.

5. Intellectual Property

Micromag Platform: All aspects of the Micromag platform, including but not limited to the design, layout, features, functionality, and source code, are owned by Micromag and are protected by copyright, trademark, and other intellectual property laws.

Trademarks: "Micromag" and the Micromag logo are trademarks of Micromag. You may not use our trademarks without our prior written permission.

Third-Party Content: Micromag integrates with third-party services such as Unsplash for images, Giphy for GIFs, and Freesound for audio. When using third-party content, you must comply with the applicable terms and licenses of those services.

6. Privacy and Data Collection

Your privacy is important to us. We collect and process personal data as described in our Privacy Policy. By using Micromag, you consent to our collection and use of your information in accordance with our Privacy Policy.

We use cookies and similar technologies to improve your experience on our platform. You can manage your cookie preferences through your browser settings.

7. Service Availability

While we strive to provide reliable service, Micromag is provided "as is" and "as available." We do not guarantee that our service will be uninterrupted, secure, or error-free.

We reserve the right to modify, suspend, or discontinue any part of our service at any time without prior notice.

8. Disclaimer of Warranties

MICROMAG IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the service will meet your requirements or that it will be suitable for your purposes. We do not guarantee the accuracy, completeness, or reliability of any content published by users.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICROMAG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS (WHICH MAY BE ZERO IF YOU ARE USING OUR FREE SERVICE).

10. Indemnification

You agree to indemnify, defend, and hold harmless Micromag and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the Micromag platform
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

11. Copyright Infringement

We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us at andrew@micromag.app with:

• A description of the copyrighted work that you claim has been infringed
• The URL where the allegedly infringing material is located
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement of accuracy and authorization to act on behalf of the copyright owner

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of Micromag after any changes to these Terms constitutes your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Micromag operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of Micromag shall be resolved in the courts of competent jurisdiction in that location.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Micromag regarding your use of the platform and supersede all prior agreements and understandings.

16. AI Services and Data Processing

Third-Party AI Providers: Micromag utilizes artificial intelligence services provided by OpenAI and Anthropic to facilitate content generation, layout assistance, and document analysis features (such as the AI Design Assistant and Quick Start).

Data Processing and Storage: When you use these AI features, including the "Upload Reference Files" feature, your data (including text, PDF, CSV, TXT, and MD files) may be transmitted to and processed by these third-party providers. We use Cloudflare R2 for secure, temporary storage of files used during these processes.

AI Content: You are responsible for reviewing and verifying the accuracy of any content generated by AI services on our platform. Micromag does not guarantee the accuracy or reliability of AI-generated content.
